I need help with someone helping me pay my property taxes I owe 2009 and 2010 property taxes. I owe $348.75 for 2009 and $319.55 for 2010 property taxes. I don't make enough to pay these. I work from my home in commission work and things have been really slow and I can barely pay my light, phone and internet I need this for the phone work. A list of resources has been compiled to assist East Lansing residents with tax help and assistance for financial hardship. Please note, anyone seeking a hardship exemption MUST contact the assessor's office in the city or township in which they reside.

 

Tax Help

Municipal (Local) Hardship Provision - State Property Tax Law requires all municipalities (local governments) to have a provision for low-income hardship cases. The local unit can only grant hardship for the current year. If you are experiencing hardship, call your local assessor. If you are an East Lansing resident call (517) 319-6880 for more information or to request a hardship application.

  • State of Michigan Homestead Property Tax Credit - filed for all years (2005-2008). If unsure of prior filing, call Michigan Department of Treasury at (517) 373-3200. This document should be filed every year - if a property owner and inhabitant has no income, he or she can file Form MI-1040R Michigan Homestead Property Tax Credit Claim only (this form can stand along - it is not necessary to file State of Michigan 1040 Income Tax Return Form).
  • Capital Area Community Services (CACS) - connects you to organizations and agencies that best fit your needs and circumstances. Some services offered by CACS are year round income tax preparation, property tax assistance as well as money management, debt reduction and credit repair. Call (517) 393-7077 (or 1-800-649-3777).
  • Capital Area United Way - A 24 hour confidential resource hotline. Specialists can refer you to agencies best able to help with your specific needs. Call 2-1-1 (or 1-866-561-2500).

 

 

Assistance for Financial Hardship

  • Department of Human Services (DHS) - The DHS may be able to assist with mortgage payments, property taxes and home insurance for people in danger of losing their homes. There is a $2,000 lifetime limit for home ownership services. Eligibility is based on numerous factors including income, group size, household's past history and housing affordability. To request an application, please contact Ingham County Department of Human Services at (517) 887-9400 or visit the office between 7:30 a.m. and 5 p.m., Monday through Friday.
  • www.holdontoyourhome.org - Ingham County has compiled www.holdontoyourhome.org that includes information on mortgage and tax foreclosure prevention and how to hold on to your home.

 

Other Possible Sources of Funding:
A. Veteran's Administration - If the taxpayer is a veteran or a widow of a veteran, he or she may qualify for an emergency grant of $500. Please contact the Veteran Administration office at (800) 827-1000.
B. Low Income Elderly - The Tri-County Office on Aging has a crisis center which may have emergency funding available. Please contact their office at (517) 887-1440 or (517) 483-7205 (after normal business hours). They can help you find certified housing counselors to discuss financial options, including reverse mortgages.
C. Religious Groups - Many local houses of worship and spiritual groups have funding available to assist members in crisis. Please contact your local spiritual advisor to discuss the situation.
D. Hardship Pension Withdrawals - Many contributing pension plans have provisions for emergency hardship withdrawals. Please contact your provider to find out if your plan has this type of provision.
E. Local Utility Assistance - The Board of Water and Light (517) 702-6006 and Consumers Energy 1 (800) 477-5050 have programs to assist residents with the payments of their utility bills. If you are a Consumers Energy user, are 65 year or older and head of a household, you may qualify for lowering your billing rates.
F. Legal Assistance - Legal counseling and referrals for homehowners who may need legal advice to resolve problems with lenders or title to the property may want to contact Legal Services of South Central Michigan at (517) 394-3121 for assistance. The Sixty Plus Elderlaw Clinic may also be available to help qualifying individuals. Their phone is (517) 334-5760.

WHAT'S NEW:  The Department of Treasury will be implementing PA 585 of 2008 fully for tax year 2010. Form 2252, Tax Exemption Affidavit should be filed for summer and winter 2009.

Public Act 585 of 2008 was signed by the governor on January 20, 2009. It requires facilities owners to file Form 4719, Request for Senior Citizen Cooperative Housing Tax Exemption with the local assessor before December 31, 2009 to claim an exemption. Facility owners will need to file the Annual Confirmation of Eligibility for Senior Citizen Cooperative Housing Tax Exemption Affidavit by May 1 of each subsequent tax year beginning with May 1, 2010. All facility owners should be aware that if the Annual Confirmation of Eligibility for Senior Citizen Cooperative Housing Tax Exemption Affidavit is not filed by May 1, 2010, and every year thereafter, the State of Michigan will not pay the tax liability for the year in which the Affidavit was not received. The exemption is revoked for non filing and the facility owner will be responsible for paying the tax liability for that tax year.

As required by law, each facility must reapply for exemption during the 2009 tax year for the tax year ending 2009. New and existing facilities can apply any time during 2009, as soon as forms are available, so that their exemption can be approved by December 31, 2009 for the 2010 tax year.

GENERAL INFORMATION:

The Department of Treasury, Finance and Accounting Division is responsible for payment in lieu of property taxes for senior citizen and disabled housing facilities under Section 211.7d of the Michigan Compiled Laws. There are currently about 175 senior citizen and disabled housing facilities that have their local municipality reimbursed under this exemption for their property taxes as a payment in lieu of taxes under this law. A facility is determined by the local assessor to be eligible for this exemption under the law. The facility and the Michigan Department of Treasury are notified in writing by the assessor of the facilities approval or disapproval of being eligible for the exemption.

Only facilities that have been approved by the local assessor and Department of Treasury as being eligible for the exemption and having submitted their 4720, Annual Confirmation of Eligibility for Senior Citizen Cooperative Housing Tax Exemption Affidavit may have a payment in lieu of tax submitted for payment. The state will only pay real and personal property taxes, not administrative fees, special assessments or penalty and interest fees.

Submission of the first payment in lieu of tax is dependent upon when the facility applies for the exemption. The 4719, Request for Senior Citizen Cooperative Housing Tax Exemption begins December 31 of the year in which the exemption is being requested. The facility has to have been occupied on December 31 of the year for which an exemption is being requested. The owner of the facility must submit a 4720, Annual Confirmation of Eligibility for Senior Citizen Cooperative Housing Tax Exemption Affidavit, which is due May 1. If the Annual Confirmation Affidavit is not submitted by May 1 the property exemption is revoked and the property shall be assessed and shall be subject to the collection of taxes becoming the facility owners' responsibility.

For example, the facility is constructed and has the first resident move in on March 15, 2009 or ownership changes to a type that now qualifies for the program. The owner would need to submit a 4719, Request for Senior Citizen Cooperative Housing Tax Exemption, to the local assessor, which begins December 31 of the year the exemption is requested. The owner would need to submit a 4720, Annual Confirmation of Eligibility for Senior Citizen Cooperative Housing Tax Exemption Affidavit no later than May 1, 2010; the first payment in lieu of tax to be considered for payment by the State would be the statement due from the local treasurer December 1, 2010. The State continues payment of property taxes as long as eligibility requirements are met and proper forms are submitted as required.

REQUIREMENTS: M.C.L. 211.7d has enabled the State of Michigan to pay the property taxes as a payment in lieu of taxes of senior citizen and disabled housing facilities that satisfy the following criteria:

    * The housing must be owned and operated by a non-profit corporation or association, by a limited dividend housing corporation, not otherwise tax-exempt;
    * The housing must be occupied solely (with the exception of a caretaker) by the elderly 62 years of age, as defined in Section 202 of the title II of the housing act of 1959, or the disabled, as defined in Section 811 of subtitle B of title VIII of the Cranston-Gonzalez national affordable housing act;
    * The housing must consist of 8 or more residential units in 1 or more structures;
    * The housing must have been qualified, built or financed under Section 202, 236 or 811 of the National Housing Act.
    * "Housing" means new or rehabilitated structures with 8 or more residential units in 1 or more structures.

4719, Request for Senior Citizen Cooperative Housing Tax Exemption (completed by owner)

DOCUMENTATION FOR SUBMISSION: Owners should submit the following documents to the local assessor to assist them in making a determination of eligibility. After the local assessor has determined eligibility under the law, copies of the documentation should be forwarded to the Department of Treasury:

    * A copy of the owner's Articles of Incorporation, showing nonprofit status or limited dividend housing corporation;
    * A copy of the HUD Mortgage, or other documentation, showing that the facility was financed, or qualified for financing under Section 202, 236 or 811;
    * Documentation showing that the facility contains at least eight units;
    * A copy of the Occupancy Permit, along with a statement giving the date the first resident actually moved into the facility;
    * Documentation showing New or rehabilitated structures.
    * General information regarding the facility, including its name, address and phone number and the name, address and phone number of its management company.

4720, Annual Confirmation of Eligibility for Senior Citizen Cooperative Housing Tax Exemption Affidavit form (completed by owner, due annually May 1)

    * The owner of a facility with an approved exemption must annually submit the 4720, Annual Confirmation of Eligibility for Senior Citizen Cooperative Housing Tax Exemption Affidavit (completed by owner, due annually May 1) to retain the exemption. This form is submitted to the Michigan Department of Treasury and the assessor of the local tax collection unit.
    * If the form is not submitted by May 1 the property exemption is revoked and the property shall be assessed and shall be subject to the collection of taxes; becoming the owners' responsibility.

PAYMENT IN LIEU OF TAX STATEMENT:

If approved, the procedure for submitting payment in lieu of tax statements to the State for payment is as follows:

4736, Payment in Lieu of Taxes Exemption Affidavit for Senior Citizen Cooperative Housing (completed by treasurer)

   1. Local treasurer completes form 4736, Payment in Lieu of Taxes Exemption Affidavit for Senior Citizen Cooperative Housing. A breakdown of millage rates must be supplied. Please note that millage rates of up to 18 mills for school operating and 6 mills for State Education Tax should not be billed or assessed, these taxes are excluded from billing. (Refer to MCL 211.7d section (4)(d)). Forms and tax statements are due December 1.
   2. The taxable value for properties already exempt under this section must be the taxable value on the assessment roll in the 2008 tax year. For new exemption requests; the taxable value of the property should be the value on the assessment roll in the year in which a claim for exemption is made or for new construction the property's taxable value on the assessment roll in the year in which construction is completed and a certificate of occupancy issued.
   3. The local treasurer will send the completed form with original signatures and copies of the real and/or personal payment in lieu of tax statement to be paid to the Department of Treasury address listed below. Millage rates must be included on the statement or they may not be paid timely, these millage rates can be on a separate sheet, if necessary.

NOTE FOR ASSESSORS: Per the State Tax Commission, to establish 2010 year values review the following:

For the 2010 year an assessor will override the system and input the taxable value from 2008. The 2009 taxable value (which will now be incorrect) could have been corrected by taking it to the December Board of Review. If that option wasn't utilized, they may file a Notice of Omitted Property, Form 627 PDF icon with the Commission.

PROPERTY TAX CREDIT FOR RESIDENCE: Since the State of Michigan is making payments in lieu of taxes on the facility, its residents are not eligible for a Property Tax Credit when filing their state income tax return.

I am writing this letter today to give you an idea of what is going on in my life. My husband of 12 years has been gone for almost 2 years now. He was incarcerated for something that supposedly happened over 23 years ago and everything from day one was handled illegally on the systems part and our lawyers. It turns out that our overpriced lawyers were friends with the DA?? My husband ran a successful moving business before he became incarcerated but because of being in and out of court for a year prior and lawyers fees we ended up with a second mortgage and huge credit card debt. I have two small children, one not even in school yet and I am begging for help. I have the 2 mortgages, credit cards, utilities and a car payment to maintain and I am unable to at this time. I am doing everything I can to stay out of bankruptcy court because when my husband comes home which is in less than a year I know he will work his tail off to recover us financially. Right now I am $1100 in the rears on property tax. I have never been behind on taxes but cannot lose our house. Being a severe asthmatic, the onset of stress on my life leads to major problems with the asthma. I’ve have to be careful of what I do; needing to be careful not to aggravate the asthma problems. I am in a desperate temporary situation!  I appreciate you taking the time to read this and consider my dilemma. hi I am a single female, am an artist and started a retail business with nothing and have kept it going for 6 yrs. but the past 2 have the MOST unimaginable. So many bad events I actually feel cursed. Being alone with a house and a business and trying to transform the A.D.D. artist INTO a business woman is a lot for person.My house needed LOTS of work 2 years ago and I was TOTALLY ripped off by 5 separate contractors--I intend on pressing charges but that too costs money and I need to prioritize. SINCE I knew I could not trust any worker alone in my house, and my home needed (STILL needs) normal amenities I was offered help from a friend to keep an eye on the shop while I babysat the workers.....WELLLLLL she needed babysitting as well some deposits mysteriously vanished (as well as a bank stealing from me---a WHOLE other ball of wax.. SERIOUSLY could write a book, but was done a terrible injustice and have no means to fight them)...well in the course of all this....a competition (franchised) store with much more money opened LESS than 2 miles from my store....wah wah wah.....bottom line, gas has been off since May....house at that time went into foreclosure, but I pulled a rabbit out of my hat and saved it...but NOW the workout payments are DOUBLE what they were and I was struggling with previous!...the water JUST got turned back on after a 2 week drought.... D.H.S. is LESS than helpful...I have been waiting for 3 weeks for the prior approved funds to be re-approved all by a simple piece of paper that was SUPPOSED to have been mailed to me and cannot get another-- the whole system is confusing to a non-systemer,--I JUST WANT TO CRY!!!! the system needs a SERIOUS restructure!...paid taxes since I was 16 and cannot get a straight answer and was humiliated by the 'social' workers---OH and not having a CAR (yeah U guessed it a drunk ran a red and I totaled my reliable transportation....$ paid the bank....hit and run of course too so no recourse)......ALL this while my credit is being destroyed trying to keep everyone happy and not doing that good of a job!...there is SOOO much more that has happened it is truly UNBELIEVABLE...and every time someone says....'well it can't get any worse'....IT DOES!...since the heat was off in May (didn't miss it in the summer heat and Tide has cold water wash!!!)...anyhow all of the heating funds through the assistance programs were depleted,  so no heating dollars exist because I supposedly make too much money..HA!...DTE is requesting a large deposit and reconnection fee on top of my charges which doubles the amount...It is really cold and I am really scared---pipes freezing, or ME....recently as well, my store was broken into and $ and inventory stolen...I have no one to turn to for help....I was/am soo proud of my store and know that it has a future as soon as I can get back out of this hole and afford the advertising /new merchandise(also pay the vendors that I currently owe)/ and catch up the back rent. My semi-understanding landlord, HAS served eviction papers ONLY to validate that money IS owed....ANY assistance or suggestions would be incredible as life's hole gets deeper and deeper---I DO NOT want to file bankruptcy---HONESTLY this is only a small portion of my cursedness...it is amazing I have not had a full blown meltdown!....I want to get my home finished so i have a peaceful environment and can get myself ORGANIZED, i KNOW this will help tremendously!...I THANK YOU in advance!

$3500 due in delinquent sales taxes from business

$3000 owed to friends who helped me save my house

$2000 in way overdue student loan

$6000 due to vendors for store inventory--thankfully they are understanding

$1000 due to re-connect my natural gas utility

$1000 due to nextel/sprint for unpaid balance on turned off cell phone (there are several disputes, I am tired of going around and around...do not have the time OR the energy)

$700 due in outstanding advertising debt

$300 behind on my phone bill---AND they left my BUSINESS INFO
OUT of the yellow pages...AND listed it as an UNPUBLISHED

$5000 in credit card debt--most is for business and the remodeling which is STILL not finished

$500 outstanding bad checks-with THEIR collection fees

$500 past due VET bill

thanks have viewed a few...but my roadblock is the fact that i do not have any kids...i think i should be REWARDED for not bringing mouths into the world that i cannot afford...but it is the opposite i get closed doors everywhere i go...thanks though
